After further testing choosing any other channel other than the default channel 36 either disables the 5ghz radio or causes the router to become uresponsive.....

On r30919 I am seeing a similar problem, enabling wifi on the 5GHz and changing the setting makes the router unusable most of the time. It is recoverable from emergency mode, where I can go in and wipe out the wireless settings to get it going again.

The problem appears to be more to do with HT40, it looks like everything is ok with HT20, and HT40 (channel above) does work on the default channel 36. Some channels don't cause the router to stop working they simply cause the radio to turn itself off right after turning on.

Some output results:
root@Gateway:~# wifi
Configuration file: /var/run/hostapd-phy0.conf
Using interface wlan0 with hwaddr c0:3f:0e:7d:46:2e and ssid 'OpenWrt'
Configuration file: /var/run/hostapd-phy1.conf
HT40 channel pair (40, 1) not allowed
Interface initialization failed
rmdir[ctrl_interface]: No such file or directory

This is for an attempt with the channel set to 40 (5.2ghz) HT40 2nd channel above.

Another:
root@Gateway:~# wifi
'radio0' is disabled
'radio0' is disabled
Configuration file: /var/run/hostapd-phy1.conf
HT40 channel pair (165, -1) not allowed
Interface initialization failed
rmdir[ctrl_interface]: No such file or directory

This was the initial test I did, using channel 165 (5.825ghz) with HT40 2nd channel below.

dmesg provides no hints as to what might be going on. What other information can I provide or tests can I do to help with this?

Sorry the formatting got all messed up with those. Let me try that again.
